The SDK page says individuals and small-scale enterprises are exempt except for Expandable Applications such as avatar systems, and sets a separate 20 million yen annual-sales trigger for VTuber tracking software; the agreement defines small scale as latest sales under 10 million yen. The sources do not state whether an avatar built from a Cubism model and displayed in third-party tracking software is itself an Expandable Application. Evidence that would answer it: the agreement's definition clauses (Japanese text prevails), earlier agreement versions and Live2D's published FAQ or support replies.

Why this is still open: The pages read give a one-line definition and thresholds in three places with slightly different scope; the agreement's definition sections were not read.
